These Terms and Conditions ("Terms") govern your access and use of the Zayka mobile application and website (zayka.app), operated by Zayka Technologies Pvt. Ltd. (“Zayka”, “we”, “us”, or “our”).
By using our platform, you agree to be bound by these Terms.
1. Eligibility
To use Zayka, you must be at least 13 years old and capable of entering into a binding contract under Indian law. If you are under 18, you must use the platform under parental or guardian supervision.
2. Use of the Platform
You agree to:
Provide accurate information while registering or placing orders.
Use the app or website for lawful purposes only.
Not misuse or interfere with the platform’s services, including hacking, copying, or distributing unauthorized content.
3. Account and SecurityYou are responsible for maintaining the confidentiality of your account login information.
Notify us immediately of any unauthorized use or breach.We reserve the right to suspend or terminate accounts suspected of fraudulent activity.
4. Order Process
Orders placed through Zayka are forwarded to our partner restaurants and delivery partners.
Zayka is a facilitator and not directly responsible for food preparation.
Estimated delivery times may vary depending on location, traffic, and restaurant availability.
5. Cancellations & RefundsOnce an order is placed and accepted by a restaurant, it cannot be canceled unless the restaurant is unable to fulfill it.Refunds (if applicable) are processed in line with our Refund Policy.
6. Content and Intellectual Property
All logos, app designs, visuals, and written content are the property of Zayka.
You may not copy, reproduce, or use our branding or content without prior written permission.
7. Third-party Links
Our platform may contain links to third-party websites or services. Zayka is not responsible for the privacy practices or content of these external sites.
8. Limitation of Liability
Zayka is not liable for:
Delays in delivery due to force majeure or trafficHealth issues related to food consumed from third-party vendorsLoss or damage resulting from technical issues or misuse of the app
9. Modifications to the Terms
We reserve the right to modify these Terms at any time. Updated terms will be posted on this page and effective immediately upon publication.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
